Springfield Coal Company, LLC v. Illinois Workers’ Compensation Commission

Respondent appealed from a judgment of the circuit court that confirmed in part and set aside in part a decision of the commission awarding benefits to the claimant under the Workers’ Occupational Diseases Act. The appellate court found that the circuit court did not have jurisdiction to review the commission’s decision where claimant’s request for summons was file-stamped after the 20-day filing period and he failed to file proof of mailing the written request for summons in the circuit court within 20 days after he received the commission’s decision.
