Plaintiff appealed from a circuit court order dismissing its complaint for administrative review by finding that proper summonses were not issued within 35 days of service of the administrative decision, as is required by the Administrative Review Law. The plaintiff argued on appeal that the circuit court erred when it found that the summonses were deficient. The appellate court reversed and remanded, finding that the circuit court’s decision was incorrect as a matter of law and that any technical deficiency in the form of the summonses was not so substantial as to warrant a dismissal of the administrative review action.
