Plaintiffs filed a lawsuit against the defendants in their official capacities as members of the State Board of Elections, alleging that the board members improperly certified the form of the ballot for a constitutional amendment voted on in the November 2022 election and improperly certified the results of the election. The trial court granted the defendants’ motion to dismiss and plaintiffs appealed. The appellate court affirmed, finding that the trial court correctly concluded that it lacked subject matter jurisdiction over the matter and that the plaintiffs’ complaint failed to state a claim for declaratory judgment.
