In re Marriage of Calcagno

Respondent appealed from a trial court order in which the court granted the petitioner’s’ motion for temporary exclusive possession of the marital residence under the Illinois Marriage and Dissolution of Marriage Act. Respondent argued on appeal that the trial court relied on improperly admitted evidence and that the order was contrary to the manifest weight of the evidence. Petitioner sought dismissal of the appeal for lack of appellate jurisdiction. The appellate court denied the motion to dismiss the appeal, but affirmed the trial court order finding that the trial court’s order was not contrary to the manifest weight of the evidence.
