Petitioner appealed from the trial court’s dismissal of her section 2-1401 motion to vacate a 2017 child support modification in which she argued that the circuit court lacked jurisdiction to enter the 2017 order modifying the child support obligations of her child’s father. The circuit court found that it had jurisdiction because petitioner’s attorney appeared at a court date in 2015 and represented respondent without objection to jurisdiction. The appellate court affirmed, finding that the trial court did not err where the record established that the actions of the parties at the 2015 hearing suggested that they were willing to proceed with the case on the merits.
