Plaintiff filed a personal injury lawsuit alleging negligence and premises liability after she slipped and fell while walking her dog on the defendant’s premises. The trial court granted defendants’ motions in limine to bar plaintiff’s expert and for summary judgment and plaintiff appealed. The appellate court affirmed, explaining that it did not need to address whether the trial court erred in barring the expert’s testimony because even if it was taken into account plaintiff failed to present sufficient evidence to create a question of fact as to actual or constructive notice where the evidence established that plaintiff’s fall was caused by ice that was covered by snow.
