Defendant appealed from his pretrial detention, arguing that disorderly conduct was not a detainable offense, that the State did not properly file an updated petition when defendant was indicted on new charges, the State did not prove that defendant committed the charged offenses, the State did not prove that defendant posed a real and present threat, and the State did not prove that there were no conditions of release that could mitigate the threat. The appellate court rejected these arguments and affirmed, finding that the trial court did not err in granting the State’s petition for pretrial release. (MITCHELL and WILSON, concurring)
