Respondent appealed from an order of the circuit court that imposed additional terms and conditions on his parenting time, arguing that the Illinois legislature did not intend for section 607.5(c)(1) of the Dissolution Act to be a medium for imposing restrictions or modifications of parental decision-making or parenting time, that the circuit court erred when it imposed one-sided restrictions on his parental responsibilities without a finding of serious endangerment or significant impairment of the children’s emotional development, and by imposing additional terms and conditions that were inconsistent with the previous allocation of parenting time. The appellate court found the first question to be dispositive and agreed with respondent, finding that the circuit court abused its discretion by imposing terms in reliance on section 607.5 and without adhering to sections 603.10 or 610.5 of the Dissolution Act.
