Tort Immunity Act
Plaintiff filed a civil tort action against multiple defendants for injuries that her son suffered when he fell from an inflatable slide during a school event. The trial court granted defendants’ motions to dismiss pursuant to the Tort Immunity Act and plaintiff appealed. The appellate court affirmed in part and reversed in part, finding that the trial court erred to the extent that it dismissed claims premised on the slide being a “hazardous recreational activity” and remanded for further proceedings for the trial court to determine whether the slide constituted a hazardous recreational activity for the purposes of the Tort Immunity Act.
