In a lawsuit arising out of a dispute regarding the management of a limited partnership the plaintiffs filed a complaint alleging claims for judicial expulsion of the general partner, breach of fiduciary duty, and breach of contract. Defendant filed a counterclaim alleging breach of contract against the plaintiff’s for failure to respond to a capital call. The trial court granted summary judgment in favor of defendants on plaintiffs’ claims. The court also granted summary judgment in favor of the defendant on its motion for partial summary judgment on its counterclaim. The court also ordered the limited partner plaintiffs to pay their respective amounts owed under the capital call and plaintiffs appealed. The appellate court affirmed, finding no error.
