Tort Immunity Act
Plaintiff filed a civil tort action against multiple defendants, including a local municipality, for injuries he suffered when he was hit by a car after police officers dropped him off in an area unknown to him following a complaint that he was trespassing at a hospital. The circuit court granted summary judgment for the municipal defendants pursuant to the Tort Immunity Act and plaintiff appealed. The appellate court reversed and remanded, finding that a genuine issue of material fact existed on the question of whether the officers were acting in a law enforcement capacity or community caretaking capacity.
