Illinois Appellate Court
Civil Court
Medical Malpractice
In a medical malpractice case, the defendants appealed after the jury returned a verdict in favor of the plaintiff and denied the defendants’ post-trial motions. On appeal, defendants contended that plaintiff’s expert testimony was not sufficient to prove negligence and causation, that the verdict was against the manifest weight of the evidence, that the trial court erred in evidentiary rulings and in denying a jury instruction, and that the verdict was excessive. Defendants also challenged the prejudgment interest award. The appellate court rejected defendants’ arguments and affirmed. (HYMAN and GAMRATH, concurring)
