Defendant, who was charged with unlawful possession of a weapon by a felon, appealed from the circuit court’s pretrial detention order, arguing that based on new evidence presented at the hearing on the motion for relief the court erred in ordering him detained. The appellate court affirmed, finding that it was improper to introduce new evidence in support of a motion for relief and that the appropriate place to do so was a section 110-6.1(i-5) hearing where the court is required to consider whether continued detention is appropriate.
