Breach of Contract
Plaintiff filed a lawsuit alleging breach of contract, conversion, and unjust enrichment against a former business partner of a business that provided excavation and hauling services for construction sites as well as a complaint for breach of contract against a general contractor that the company provided services for. The trial court granted summary judgment for the defendants and plaintiff appealed. The appellate court agreed with plaintiff’s arguments on appeal, in part, finding that the trial court incorrectly equated the transfer of a project with the transfer of payment for work that was completed prior to that transfer and remanded with instructions.
