Respondent filed an unfair labor practice charge with the local panel of the Illinois Labor Relations Board. Respondent did not serve a copy of the charge on the petitioner, but the Board provided petitioner with a copy of the charge and issued a formal complaint for hearing and ultimately found in favor of the respondent. On appeal, petitioner argued that the Board did not have jurisdiction to issue the complaint because respondent failed to serve a copy of his charge on the petitioner. The appellate court affirmed, finding that the Board acted within its statutory authority when issuing the formal complaint for hearing and that its failure to follow its own rules and regulations was not arbitrary or capricious.
