Pretrial Release
Defendant was arrested and charged with first-degree murder and appealed from a circuit court order denying his pretrial release. On appeal, defendant argued that the trial court misconstrued provisions of the Electronic Monitoring and Home Detention Law as barring his pretrial release. The appellate court agreed with defendant that the statute did not contain any restrictions on pretrial detainees and vacated and remanded. (KENNEDY and MULLEN, concurring)
