People v. Mayer

Defendant appealed from an order denying his motion for relief from an order granting the State’s petition to detain him prior to trial. On appeal, defendant argued that the attorney who represented him during the detention hearing and during his motion for relief labored under a per se conflict of interest. The appellate court affirmed, finding that defendant waived the issue by failing to raise it below in his motion for relief. (DeARMOND and HARRIS, concurring)
