Illinois Appellate Court
Civil Court
Causation
Plaintiffs brought a wrongful death lawsuit after their minor son died by suicide alleging that the defendants did not do enough to investigate, prevent, and remediate bullying that their son experienced at school. The trial court dismissed most of the claims and entered a SCR 304(a) finding. The appellate court affirmed, finding that the circuit court did not abuse its discretion where the complaint did not allege facts that would establish a causal connection that tied the decedent’s emotional distress or decision to end his own life to the actions or inactions of the defendants.
