Illinois Appellate Court
Civil Court
Utility Rates
In a consolidated case, the plaintiffs appealed from multiple orders issued by the Illinois Commerce Commission in a utility rate case. In the orders, the commission set plaintiff Commonwealth Edison Company’s return on equity, denied it a recovery on its pension asset, and imputed a capital structure. In a lengthy opinion, the appellate court affirmed, finding that the commission did not err in its decisions and that their was substantial evidence to support its findings.
