Emergency Management Agency Act
Plaintiff appealed from an order of the circuit court dismissing his medical negligence action by finding that the defendant was immune under the Illinois Emergency Management Agency Act due to the Covid-19 pandemic. The appellate court reversed and remanded, finding that the defendant had not established that she was entitled to immunity because such immunity requires a “trigger” and the governors executive orders regarding the Covid-19 pandemic were no longer in effect at the time of the events that formed the basis of plaintiff’s complaint.
