This case presents question as to whether trial court properly granted defendant’s motion to suppress drugs found in defendant’s apartment, where police officer had obtained search warrant after officer used drug-detection dog to sniff doors in unlocked common hallway of apartment building, and where said dog alerted for presence of drugs while sniffing defendant’s front door. Appellate Court, in affirming trial court, found that police had violated defendant’s 4th Amendment rights when he entered common-area of hallway and conducted instant dog sniff, where said actions constituted warrantless “search” for purposes of 4th Amendment.
