This case presents question as to whether trial court properly dismissed at first stage of proceeding defendant’s petition for post-conviction relief on grounds that defendant lacked standing to bring such petition, where defendant had served his sentence and mandatory supervised release on conviction that was subject of petition. Appellate Court, in affirming trial court, found that issue of defendant’s standing to file petition for post-conviction relief could be resolved at first stage of proceeding, and that his petition was patently without merit because there was no arguable basis in law or fact that defendant could pursue his petition, where he had served his sentence and mandatory supervised release by time he had filed his petition.
