School District was the only District in the State which employed security agents and guards. Public Act 96-1257, which took effect in 2010, purported to remove those employees from oversight of Illinois Educational Labor Relations Board, in redefining them as "public employees" subject to jurisdiction of Illinois Labor Relations Board. Public Act 96-1257 is special legislation violative of article IV, section 13, of Illinois Constitution. Legislature had no basis for restricting reach of amendment to peace officers employed by a school district in its own police department in existence on effective date of the amendatory Act. It is irrational not to extend benefits and protection of interest arbitration to citizens of those school districts that may thereafter employ peace officers in their own police departments.(FREEMAN, THOMAS, GARMAN, BURKE, and THEIS, concurring; KILBRIDE, specially concurring.)
