Sentencing
Defendant was convicted of armed robbery and sentenced to 24 years. Enhanced sentenced for armed robbery with a firearm violated proportionate penalties clause, and thus Defendant's sentence is facially unconstitutional and void ab initio. Matter remanded to circuit court for resentencing in accordance with statute as it existed prior to adoption of sentencing enhancement.
