Defendant was convicted of burglary and possession of burglary tools and sentenced to concurrent sentences of three and two years, respectively. The issue on appeal was whether officers had reasonable suspicion to stop defendant based on the fact that he was running in the rain while holding the front of his pocket. The Supreme Court reversed the judgments of the appellate and trial courts, finding that under these facts the officers did not have reasonable suspicion to stop the defendant.
