Plaintiffs filed a complaint alleging that amended portions of the Illinois Pension Code violated the pension protection clause contained in article XIII, section 5 of the Illinois Constitution. The circuit court granted summary judgment in favor of the defendants and the appellate court affirmed. The supreme court also affirmed, finding that plaintiffs had failed to identify any property right under the law that was impacted by the 2020 amendment to the Pension Code because the amendment merely changed how local fund assets were management and that it was undisputed that the pension payments plaintiffs were entitled to receive were not impacted by the amendments.
