Attorney Fees
Petitioner filed a verified petition to contest a November 2022 county clerk election. The circuit court dismissed the petition and awarded the respondent attorney fees and petitioner appealed. While the case was on appeal, respondent commenced supplementary proceedings by issuing citations to discover assets to the petitioner. Respondent also requested attorney fees relating to the supplementary proceedings, which the circuit court denied. Respondent appealed, arguing that the circuit court erred when it refused her request for attorney fees relating to the supplementary proceedings or, in the alternative, that petitioner should be sanctioned.
