Plaintiff filed a lawsuit both individually and on behalf of similarly situated individuals alleging that defendant willfully violated the Fair and Accurate Credit Transactions Act by printing more than the last five digits of debit card numbers on receipts provided to consumers. The circuit court granted plaintiff’s motion for class certification and the defendant appealed pursuant to Illinois Supreme Court Rule 306(a)(8). The appellate court affirmed the certification but the Illinois Supreme Court reversed, finding that plaintiff lacked standing to bring her FACTA violation claim because she did not allege a concrete injury and, as a result, the granting of class certification was erroneous. (NEVILLE, OVERSTREET, CUNNINGHAM, ROCHFORD, and O’BRIEN, concurring. THEIS took no part in the decision)
