Respondent was adjudicated to be a delinquent minor in connection with his unlawful use of a weapon, aggravated unlawful use of a weapon, and unlawful possession of a firearm and firearm ammunition. At sentencing, the court determined respondent was a violent juvenile offender and adjudicated him a ward of the court and he was committed to the custody of the Illinois Department of Juvenile Justice. On appeal, respondent argued that the circuit court abused its discretion in declining to accept respondent’s guilty plea, that the circuit court erred in failing to strike the State’s notice to prosecute him as a violent juvenile offender, and that the State failed to meet its burden to prove that respondent was a violent juvenile offender and that the circuit court erred in calculating the sentencing credit. The appellate court affirmed, but modified his sentence to reflect a total of 139 days of pre-sentence credit instead of the originally-granted 46 days.
