Plaintiff filed a lawsuit under the Fair Housing Act and several state laws, alleging discrimination based on national origin after the owner and operator of her apartment building terminated her lease for displaying a Palestinian flag in her apartment window. The district court dismissed the case, finding no plausible discrimination. The Seventh Circuit affirmed on narrow grounds, explaining that in opposing the motion to dismiss the plaintiff pursued a novel and unsupported theory of liability and that plaintiff incorrectly asserted that a showing of discrimination was not required at the pleading stage.
