Illinois Appellate Court
Civil Court
Civil Procedure
Plaintiff filed a lawsuit against the defendants based on defendant’s alleged involvement in a legal dispute with plaintiff’s ex-husband over the custody of a cryogenically frozen embryo. The trial court dismissed plaintiff’s claims for negligence, breach of express and implied contracts, breach of fiduciary duty, and medical battery for failure to state a cause of action. The appellate court affirmed, finding that the trial court did not err in dismissing the lawsuit. (MITCHELL and ODEN JOHNSON, concurring)
