Effective Assistance of Counsel
Defendant was found guilty of first-degree murder and was sentenced to 35 years in prison. On appeal, defendant argued that he received ineffective assistance of counsel, that the trial court erred in the admission of evidence, that there was prosecutorial misconduct, and that there was a jury polling error. The appellate court reversed and remanded for a new trial, finding that trial counsel provided ineffective assistance by failing to communicate sufficiently with defendant and by failing to investigate a witness identified by the defendant.
