Plaintiff filed a lawsuit against the defendant alleging that while he was housed at a Federal Correctional Complex, he was repeatedly attacked by his cellmate and suffered serious injuries and that the defendants violated the Eighth Amendment by failing to protect him and acting with deliberate indifference to his medical needs. The district court granted summary judgment for the defendants and plaintiff appealed. The Seventh Circuit affirmed, finding that while the facts of the case were disturbing the district court did not err in dismissing the case where the plaintiff did not present a recognized cause of action and did not establish that he could overcome the defendants’ qualified-immunity defense.
