Defendant was found guilty of participating in a narcotics distribution conspiracy and possessing with the intent to distribute cocaine and heroin. On appeal, defendant challenged the district court’s denial of his motion to suppress evidence obtained from a cell-site simulator and CCTV camera and argued that the trial court should have sustained his objection to a jury instruction that permitted the jury to convict him without finding that his offenses involved a specific quantity of drugs. The Seventh Circuit affirmed, finding that the trial court did not err when it denied the motion to suppress because defendant did not rebut the presumption of good faith as to the judicially-issued warrants and that the trial court properly instructed the jury as to the law.
