Double Jeopardy
The State appealed from an order of the circuit court granting defendant’s motion to dismiss certain charges as barred under double jeopardy principles by his earlier plea in separate proceedings initiated by the Village of Carpentersville. The appellate court affirmed the dismissal, finding that defendant’s negotiated plea to, and conviction of, a lesser-included offense barred subsequent or continuing prosecution for a greater offense in a separate proceeding.
