Illinois Appellate Court
Criminal Court
Criminal Sexual Abuse
Defendant was found guilty of criminal sexual abuse and sentenced to sex offender probation for a period of 30 months. On appeal, defendant argued that the State failed to prove beyond a reasonable doubt that she used force or the threat of force to commit an act of sexual conduct. The appellate court agreed and reversed, finding that there was no proof that defendant used force beyond that which was inherent in the contact that occurred, as was required under the statute.
