Federal 7th Circuit Court
Criminal Court
Guilty Plea
Defendant pleaded guilty to assaulting a federal employee and using a gun during a crime of violence. The district court accepted the plea and sentenced him to 153 months in prison. On appeal, defendant argued that he wrongfully believed that a conviction for assaulting a federal employee counted as a crime of violence to support his conviction for using a gun during a crime of violence. The Seventh Circuit dismissed the appeal, finding that defendant repeatedly waived this argument and that the district court correctly explained the nature of the charges.
