Federal 7th Circuit Court
Civil Court
Excessive Force
Plaintiff filed a lawsuit against multiple law enforcement officers under 42 U.S.C. § 1983 alleging excessive force in violation of the Fourth Amendment for injuries he sustained during an arrest. The district court granted summary judgment for the defendants and plaintiff appealed. The Seventh Circuit affirmed in part and reversed in part, affirming the district court’s award of qualified immunity to one of the officers but reversing as to a second officer because there were disputed facts that required plaintiff’s claim of excessive force against that officer to go to a jury.
