Illinois Appellate Court
Criminal Court
Pretrial Release
Defendant, who was indicted for multiple counts of sexual assault and abuse of an underage victim, appealed from a trial court order granting the State’s petition for pretrial detention and an order denying defendant’s subsequent motion for relief pursuant to Illinois Supreme Court Rule 604(h). The appellate court affirmed, finding that detention was warranted in this case and that alternatives such as electronic monitoring would be insufficient to protect the community given the circumstances of the offense.
