Defendant appealed from a circuit court order finding in favor of plaintiff on his claims for declaratory relief and for a writ of mandamus to compel the County Clerk to place his name on the April consolidated election ballot. Plaintiff cross-appealed from a circuit court order granting the defendant’s motion for summary judgment on plaintiff’s claim for deprivation of his constitutional rights under the Election Code. The appellate court affirmed, finding that plaintiff had cured his impediment to appear on the ballot by paying outstanding financial penalties and that the County Clerk incorrectly determined he was ineligible to have his name placed on the ballot at the time he was nominated to fill a vacancy.
