Controlled Substances Act
Defendant was found guilty of possessing and distributing methamphetamine. On appeal, he argued that his convictions should be reversed and his sentence vacated because the government failed to prove he sold “illegal” methamphetamine. Defendant argued that the Controlled Substance Act covers only “optical isomers” of methamphetamine, not the generic drug, and that expert testimony presented by the government was not sufficient.
