Illinois Appellate Court
Civil Court
Benefits Act
Plaintiff, an injured firefighter, filed a complaint for declaratory judgment against defendant pertaining to plaintiff’s right to continue receiving certain health insurance benefits. The circuit court granted the defendant’s motion for summary judgment and plaintiff appealed. The appellate court affirmed, finding that under the Health Reimbursement Arrangement Plan provided by the defendant and the Benefits Act, the defendant was not required to continue providing HRA benefits because those benefits were supplemental and not mandated by the Benefits Act.
