Defendant was found guilty of unlawful possession of a weapon by a felon. On appeal, he argued that the trial court erred when it denied his motion to suppress the weapon, which defendant argued was found during an illegal search. The appellate court reversed, finding that the police lacked a reasonable, articulable suspicion that defendant was illegally armed when police stopped and frisked him and, as a result, the facts did not justify the Terry stop so that the motion to suppress should have been granted and without that evidence the State could not prove that defendant possessed a gun.
