Plaintiff filed a complaint seeking recovery under section 60 of the Employee Classification Act. The circuit court entered a default judgment against the defendants as a sanction for discovery violations and awarded the plaintiff statutory damages, attorney fees, and costs. On appeal, defendant argued that the plaintiff was not entitled to recover damages or attorney fees and costs under the Act. The appellate court dismissed the appeal as to one defendant for lack of jurisdiction and against the second defendant, the appellate court affirmed the circuit court’s award of attorney fees and costs but reversed the award of statutory damages.
