Ineffective Assistance of Counsel
Defendant was found guilty of first-degree murder and was sentenced to 65 years in prison. Defendant’s conviction was affirmed on direct appeal and defendant filed a post-conviction petition raising several claims of ineffective assistance of counsel. The supreme court held that the appellate court erred in finding that defendant’s claims of ineffective assistance of counsel were forfeited because they weren’t raised on direct appeal but nevertheless affirmed, finding that the claims failed on their merits.
