Insurance Coverage
Plaintiff insurance carrier filed a declaratory judgment action asking the court to find that the carrier did not owe coverage to its insured where the policy required notice within 30 days of an automobile collision and where the insured did not provide notice for more than two years. The circuit court granted summary judgment for the insurer and the insured appealed. The appellate court affirmed, finding that the insured’s notice was unreasonable as a matter of law and that there was no coverage under the policy.
