The appellate court considered an order of the circuit court that held the defendant hospital in contempt for refusing to produce records the hospital claimed were integral to their credentialing decision process and were privileged under the Medical Studies Act. The appellate court found that the hospital failed to meet its burden of establishing that the records were privileged and that nothing on the face of any page of the documents identified that it was initiated, created, prepared, or generated by a committee engaged in the peer review process; however, the court vacated the finding of civil contempt and the imposition of a monetary penalty.
