Plaintiffs filed a lawsuit on behalf of their children against a local school district alleging that the district’s failure to provide bus transportation to a non-public school violated section 29-4 of the School Code. The circuit court granted the district’s motion for summary judgment, finding that the transportation afforded to non-public schoolchildren was limited to the district’s existing regular bus routes and that the School Code did not require the district to modify its regular bus routes. The appellate court reversed. The Supreme Court reversed the appellate court and affirmed the circuit court, finding that transportation provided by a local school district to non-public school children is limited to transportation at points along the district’s regular bus routes.
