Four individuals filed a lawsuit against their former employer, alleging discrimination against non-South Asians. Plaintiffs relied on an expert report by a labor economist that concluded that chance alone could not explain the demographics of defendant’s employee population. The district court excluded the expert opinions and subsequently granted summary judgment in favor of the defendant and plaintiffs appealed. The Seventh Circuit affirmed, finding that the district court did not err in excluding the expert’s report and that without the report the plaintiffs could not maintain their pattern and practice claims. The Seventh Circuit also found that plaintiffs did not prove their individual disparate treatment claims. (BRENNAN and KOLAR, concurring)
