Plaintiff filed a lawsuit against the manufacturer of a cow’s milk-based infant formula alleging that the company failed to warn about the dangers associated with the formula, which resulted in the death of plaintiff’s infant daughter. The case was joined by hundreds of others in multidistrict litigation. The district court granted defendant’s motion for summary judgment and plaintiff appealed.
